NoToPests is a directory service that helps homeowners locate and contact independent, third-party pest control contractors ("Service Providers"). We do not perform pest control services, employ or supervise technicians, conduct inspections or treatments, set pricing or scheduling, or guarantee service outcomes.

We act solely as a connection service, helping users locate independent Service Providers who operate their own businesses. NoToPests.com is a website operated by Lead Sights.

2. No Professional Advice

All information provided on the Site, including articles, guides, pest identification resources, prevention tips, and recommendations, is for general informational purposes only. Content on this Site does not constitute professional pest control advice, a diagnosis of any infestation, or a treatment recommendation or guarantee.

Always consult a qualified pest control professional for evaluation, treatment, and advice specific to your situation.

3. Independent Third-Party Service Providers

When you submit information through the Site or call a phone number displayed on it, your inquiry is provided to one or more independent Service Providers so they can respond to your request. Service Providers are not employees, agents, or contractors of NoToPests. We do not control, supervise, or manage their work, and we make no representations or warranties regarding their licensing, qualifications, pricing, availability, or results.

All disputes, claims, or concerns related to pest control services must be resolved directly with the Service Provider, not with NoToPests.

4. Calls, Call Tracking, and Recording

By calling any phone number displayed on the Site, you acknowledge and consent that calls may be tracked, logged, monitored, and recorded, that call metadata may be collected, and that call information may be shared with Service Providers for routing, quality assurance, or matching purposes.

5. Electronic and SMS Communications

By using the Site, you consent to receive electronic communications from NoToPests, including notices, updates, and other information related to the Site. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

If you opt into receiving SMS or text messages, you consent to receive text messages at the phone number you provide. Message and data rates may apply. You may opt out of SMS communications at any time by replying STOP to any message. This consent is not a condition of using the Site or purchasing any services. NoToPests will comply with all applicable requirements of the Telephone Consumer Protection Act (TCPA) for any SMS communications.

6. User Obligations

By using the Site, you agree to use the Site only for lawful purposes, provide accurate and truthful information, submit inquiries only for legitimate pest control needs, and confirm that you are at least 18 years of age.

You agree not to submit false or fraudulent requests, misrepresent yourself, copy or scrape Site content, interfere with Site systems, use automated tools without written permission, or transmit harmful code.

7. Termination and Suspension

We reserve the right to suspend or terminate your access to the Site at any time, without prior notice, for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or abuse of Site systems. Upon termination, your right to use the Site ceases immediately.

8. Intellectual Property Rights

All content on NoToPests.com, including text, graphics, images, logos, videos, design elements, layout, and structure, is owned by or licensed to the Company and protected by applicable intellectual property laws. The NoToPests name, logo, and all related marks are trademarks of Lead Sights. Unauthorized use is prohibited.

9. Disclaimers and No Warranties

We expressly disclaim all implied warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content.

We make no guarantees regarding availability of Service Providers, accuracy of content, pest control outcomes, or service availability in any specific location.

10. Limitation of Liability

To the fullest extent permitted by law, NoToPests and Lead Sights, including their owners, officers, employees, contractors, and affiliates, shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, interactions with Service Providers, services performed or not performed, errors in content, unauthorized access to your data, or any other matter relating to the Site.

In no event shall our total liability exceed the amount you paid to NoToPests in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless NoToPests, Lead Sights, and their respective owners, officers, employees, contractors, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your interactions with Service Providers, your violation of these Terms or any applicable law, or any content or information you submit through the Site.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall first be attempted to be resolved through informal negotiation by contacting us at [email protected].

If the dispute cannot be resolved informally within a reasonable period, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association (AAA). Arbitration shall be conducted on an individual basis; class actions and class arbitrations are not permitted.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

14. General Provisions

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and NoToPests regarding your use of the Site and supersede all prior agreements, communications, and proposals.

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of NoToPests. NoToPests may assign its rights and obligations under these Terms without restriction.

We may modify these Terms or Site features at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.
